From what I know, I suspect this is correct. I practice food combining and know the horrors of improperly combining starches and creating fermentation. But now I must avoid all bread before setting off on a long drive.....or any drive for that matter.

It's the bread lobby at it again. It takes a lot to feed the DUI system, and in our budget-constrained economy, it looks like the state will be mining it from motorists' mouths as well as their wallets.

If ever stopped for an alleged DUI or DWAI, do not EVER, EVER, EVER submit to a breath test. Always request ONLY a BLOOD TEST, BLOOD TEST, BLOOD TEST!!!!!! Jerry Feather

doesn't this article provide ammunition to refute a Breath Test result? That the calibration of the machine is not possible to discern between the two?
Prove that the unit <you> used can present unreliable results depending on food eaten and not isolate from alcohol?

The problem with all of this is that you need an expert witness to prove all or any of these problems with the breath test for alcohol. There simply aren't any around, at least not around here that I know of. Your are right that the breathalizer cannot distinguish betweeen any kinds or or sources of alcohol. To the machine alcohol is just alcohol. The supposed distinction of stomach alcohol is not the kind of alcohol, but simply based on a spike in the reading that indicates that a lot of alcohol is present and therefore might be from the stomach and not from the lungs.
There are a lot of problems with the breath tests for alcohol, but none of them are in your favor. That is why you should never ever ever ever take a breath test. Always request and even demand a blood test. Do not refuse to take the blood test and do not let them talk you out of the blood test for any reason.
If the blood test shows you had too much to drink you will just have to deal with that. The breath test will show as much and likely more alcohol than the blood test will show. Do not take the breath test.
Now you don't need an expert witness and the problem is solved.
Better yet, don't drink and drive.

In this state you have the choice of either a breath or Blood test, your choice. I suspect that is the same in most states. Refusing one in favor of the other has no consequece. However, one must be careful not to say "I refuse..." because that will likely be taken as a blanket refusal. One should simply say "I will consent to a blood test!!!!!" Check the laws in your state about what kind of test must be offered. Jerry Feather

In states where that is true it is the refusal of the "chemical" test all together, either one or both, not just the breath test. And, it a revocation of the license, not just a suspension, which is significant difference. Jerry Feather

I think in Cali at least if you refuse the on-site breath test they take your license on the spot. It's to prevent people from getting hauled to the tank, processed, then finally tested, which gives the perp ample time to recover under the legal limit if they are close as it is.
