Default out of province sales taxation practices?

If a dealer sells a vehicle outside their province, are they supposed to collect GST and PST? or just GST?

Ontario to B.C

AFAIK, I've heard that this goes two ways...But most often, when buying from a dealership;

1. Pay both taxes in Ontario where you buy the car.
2. Pay both taxes in BC when registering the car.
3. Apply for tax refund from Ontario with proof that the car is registered in BC.

What about buying from a private party in Quebec car and brought to Ontario? Do I need to get a temp license plate and bring it to Ontario?

FYI,

I purchased a vehicle in BC last year. I had the dealership collect 13% Ontario sales tax on the purchase price. Once the car arrived in Toronto, I took the dealer invoice and the e-test to the ministry. They saw that the taxes were paid in Vancouver.....all I had to pay were the new plates and the sticker. Easy as pie.

I would expect the same process for Ontario -> B.C.

Typically what's supposed to happen is, as a purchaser you pay only the GST.
Then when you go to plate the car, the MTO will charge you the local PST.

If the selling dealer insists on charging you both from their respective province, then you can fill out the appropriate forms to get a rebate.

Bought my old C2S from Quebec and I live in Ontario. They charged me GST in QC and then I paid the PST when I registered in Ontario.

I was thinking I would go down over a weekend, pay for it then drive it back but unsure how I could get insurance, plates to do that.

It depends on a few things, if you are getting it shipped to you, they should only charge you the GST. If you take delivery in Ontario, you should pay HST.

I bought my 993 in Quebec in Sept, and drove it back to Ontario.

All you need is the VIN to get your insurance started, and the Quebec ministry will sell you a temp permit for $10-15, good for 5 days IIRC. See the tiny sheet of paper in the upper left corner of my rear glass? That's the temp permit



As far as taxes in QC: depending on the age of the car, they won't have a book value beyond a certain age. I think they only had records going back 10yrs. So you can either make up a value and pay the local taxes on that amount and skip applying for a refund later, or, insist they charge you tax on the entire purchase price (which you'll have to apply for a refund later). In any event, MTO will not care what was stated or paid in QC, they will base the ONT taxes on your Bill or Sale (which they say they review to prevent understating the value).

+1 IIRC, and if taking delivery in Ontario and paying HST, apply for rebate to get it back after.

Need to get this sorted out as I do not wish to pay PST in two different provinces....

As an out of province resident, you can apply for a refund.

That sounds right. I think you get charged the provincial tax where you buy it (which you get refunded), then you pay the appropriate provincial and federal tax where you register the vehicle at home.

When I bought a car in the US, I was charged the GST at the border, then the PST when I registered it in my home province.

You guys are all making the discussion more complicated than it has to be.

PAY the HST wherever you purchase the car.....you do not "gain nor lose money" on where the tax is collected......once you register the car IN THE PROVINCE, the ministry will review what taxes have been or has not been paid.

Simple....end of discussion.....this is not rocket science.
