Lost in the shuffle is the fact that you are infringing on Porsche's design in the first place? They are very protective of their trademarks and designs - if this came across their desk I'm sure you'd get a cease and desist letter.

it wasn't lost in the shuffle as i made note of this earlier. though might not be correct in my assumption that he could in fact file a copyright of HIS work as he didnt in fact create the original "work".

however, in the music business when someone composes new words over someone else music, it becomes a "new" work, and while they must acknowledge and compensate the owners/holders/administrators on the old work monetarily and in terms of "writers share" it does indeed become a new "work", referred to as a "derivative" work, and as such a new copyright can be filed with the copyright office. provided of course it isn't a "work for hire" scenario.
bottom line is: porsche wouldn't take legal action unless the items market share was significant enough, and this wouldn't hit their radar ( yet ). though i agree they would send a cease and desist if it was sold and marketed and made available more "commercially". but that's a hypothetical that will not occur.
^^^ Sharkworks design. That was done after mine, to the best of my knowledge. It is however the same "idea" but executed differently. Great, they liked the idea and did their own design. No problem with that. 03EvoIII directly copied and pasted, stealing my design, and did so to his own profit. That's not right, and the point of this thread.
