My reason for stating it is a design issue is because Porsche had indication of engine problems. They did delay the production for about 30 days.

Regarding the Lemon Law as I indicated in an earlier post if the car has been out of service for 30 days in most States there is a presumption that the car is a lemon and the Owner is entitled to a refund. However, a manufacturer can rebut the presumption before an arbitrator claiming he has not had a reasonable opportunity to repair the car.
Then it is up to the arbitrator to decide whether to refund for the car or allow more time for the repair. Some manufacturers would just pay the refund and move on.

One difference between this and a refrigerator is Porsche is providing a loaner often a new one which is a sport car. They are trying to make the owner whole until which time they have had the opportunity to repair the vehicle.

Let's say I trust them that they fix the problem permanently and I can't wait to get my car back! But I does bother me IMMENSELY that I have to run it in again. I guess I'll take it to the N�rburgring this time, no pottering around, so we'll quickly see if the engine holds up ;-)

My understanding of FIA rules is pretty limited but I thought the GT3 (class) homologation (for the cup) is good until until 2020 but the GT2/GTE homologation for the 997-GT3RS expires in 2015. And for which (991RSR) Porsche had to get an engine waiver in 2014? If you search Argent for the homologation numbers in the above linked pdf you can see the various extensions Porsche has received.

20 days cumulative off the road over a 12 month period within the first two years of ownership from new - and the manufacturer unable to fix it, is the period NC defines for a car to fall into the lemon law category and then replace or refund.

Having another vehicle to drive instead is irrelevant as the issue is with the car you bought.

Seems black and white, although it's the manufacturer not the consumer that noted the car cannot be driven which is an unusual twist. Clock started then though.

I'm sure our friends in Atlanta and Germany have considered all of this. I was looking for any other reads on this ahead of tomorrow as it's time to move on one way or another. I'm not going to let this years DE season slip away, it's just a car and there are plenty of others which work out there.

The design/supplier issue are indeed two completely separate issues. Often initial testing is done with parts that are not built by the production supplier. Instead the final design specs for a part are then given to several suppliers to bid. This is where it can fall apart with the dreaded low bidder. I'm not saying this is the case here, but very likely.
